Terms of Use

1. Agreement to Terms

By accessing or using ExamCast (the "Service"), including by creating an account, browsing the website, or purchasing a subscription, you agree to be bound by these Terms of Use ("Terms"), our Privacy Policy, and our Disclaimer (collectively, the "Agreement").

If you do not agree to any part of this Agreement, you must not use the Service. We reserve the right to update these Terms at any time. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

2. Eligibility

  • You must be aged 13 or over to create an ExamCast account, in accordance with the Data Protection Act 2018 (Section 9).
  • If you are under 18, we encourage you to review these Terms with a parent or guardian before using the Service.
  • By creating an account, you represent and warrant that you meet the minimum age requirement and that all information you provide is accurate and complete.

The Service is intended for use by GCSE-level students, teachers, tutors, and educational organisations in the United Kingdom.

3. Account Registration and Security

  • Accounts are created via Google OAuth. You are responsible for maintaining the security of the Google account used to access ExamCast.
  • Each individual may hold only one ExamCast account. Account sharing is prohibited.
  • You are responsible for all activity that occurs under your account.
  • You must notify us immediately at admin.examcast@gmail.com if you suspect any unauthorised access to your account.

4. Description of the Service

ExamCast is an independent educational platform that provides data-informed GCSE revision resources, including:

  • Original predicted exam-style practice papers and mark schemes
  • Topic frequency analysis and revision priority signals
  • Worksheets and analytics dashboards
  • A community discussion platform

All content is delivered digitally via a secure in-application viewer. ExamCast does not offer physical materials or downloadable files.

5. Predicted Papers and Revision Materials

This section is fundamental to your use of the Service. By using ExamCast, you acknowledge and agree to the following:

5.1 Original Content

All predicted papers, mark schemes, worksheets, and other revision materials available on ExamCast are original content created by ExamCast. They are not reproductions, copies, or derivatives of any official examination paper produced by any awarding body.

5.2 Methodology

Our materials are based on analysis of publicly available historical examination data, published subject specifications, and publicly accessible assessment patterns. The term "predicted" refers to our data-informed methodology for estimating which topic areas may be of particular relevance for revision purposes. It does not mean that ExamCast has advance knowledge of, or access to, actual examination content from any source.

5.3 No Guarantees

ExamCast makes no guarantee, representation, or warranty whatsoever that:

  • Topics, questions, or content in our predicted papers will appear in any actual GCSE examination.
  • Using ExamCast materials will result in any specific grade, mark, or examination outcome.
  • Our materials match the exact format, style, difficulty, or mark allocation of any actual examination paper.
  • Our analysis of topic frequency or question patterns is a reliable indicator of future examination content.

5.4 Supplementary Use Only

ExamCast materials are intended as supplementary revision resources only. They are not a substitute for classroom teaching, official revision guides, past papers published by awarding bodies, or any other authoritative educational resources. You should use ExamCast as one component of a broader, well-rounded revision strategy.

5.5 No Access to Confidential Content

ExamCast does not have access to, and has never had access to, any confidential, proprietary, embargoed, or pre-release examination content from any awarding body or any other source. All our materials are produced independently using publicly available information only.

6. No Affiliation with Examination Boards

ExamCast is an independent educational resource provider. ExamCast is not affiliated with, endorsed by, authorised by, licensed by, or in any way officially connected to any UK or international examination board or awarding body, including but not limited to:

  • AQA (Assessment and Qualifications Alliance)
  • Edexcel (Pearson Education Ltd)
  • OCR (Oxford, Cambridge and RSA Examinations)
  • WJEC (Welsh Joint Education Committee)
  • CCEA (Council for the Curriculum, Examinations and Assessment)

Any references to examination boards, their specifications, or their qualifications within ExamCast are made solely for the purpose of identification and contextual reference. All examination board names, logos, and trademarks are the property of their respective owners and are used under principles of fair and nominative use.

7. Intellectual Property

  • All content on ExamCast - including predicted papers, mark schemes, worksheets, analytics, text, graphics, and software - is the intellectual property of ExamCast and is protected by copyright law.
  • You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use ExamCast content for your personal, non-commercial educational purposes only.
  • You must not copy, reproduce, distribute, publish, transmit, sell, resell, or otherwise exploit any ExamCast content, in whole or in part, without our prior written consent.
  • Content is delivered via a secure in-application viewer. Any attempt to circumvent, bypass, or disable the security measures of this viewer is strictly prohibited and may constitute a criminal offence under the Computer Misuse Act 1990.

8. Subscriptions and Payments

8.1 Plans

  • Free tier - no payment required. Provides limited access to ExamCast features.
  • Premium Monthly - currently priced at £5.99 per month.
  • Premium Annual - currently priced at £45.99 per year.
  • All premium subscriptions include a 3-day free trial. A valid payment method is required to start the trial.
  • We reserve the right to change pricing at any time. Existing subscribers will be notified of price changes before their next billing cycle.

8.2 Billing and Renewal

  • Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date.
  • All payments are processed by Stripe. ExamCast does not store your payment card details.
  • You can manage your subscription and payment methods via the billing portal accessible from your account page.

8.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. You will retain access to premium features until your current period expires. No partial refunds are issued for unused time within a billing period.

8.4 Refunds

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may request a refund within 14 days of your first payment. To request a refund, contact us at admin.examcast@gmail.com.

By accessing premium digital content during the refund period, you acknowledge that the supply of digital content has begun with your consent, which may affect your right of withdrawal under the Consumer Rights Act 2015 (Section 36). We will assess refund requests on a case-by-case basis.

9. Community Features

  • Community posting and replying are available to premium subscribers only.
  • Rate limits apply: a maximum of 2 posts and 2 replies per 7-day period per user.
  • All users may view public community content and like posts.

You must not post content that is:

  • Offensive, abusive, threatening, defamatory, or discriminatory
  • Spam, advertising, or promotional material
  • A reproduction or sharing of any examination content (including ExamCast materials)
  • Impersonation of another person or entity
  • Otherwise unlawful or in breach of these Terms

ExamCast reserves the right to moderate, hide, or remove any community content at our sole discretion and without prior notice. Users may report content they believe violates these guidelines.

10. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable UK or international law.
  • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or any systems or networks connected to the Service.
  • Use automated scripts, bots, scrapers, or similar tools to access, extract, or interact with the Service.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of any part of the Service.
  • Circumvent, disable, or interfere with any security, access control, or digital rights management features of the Service.
  • Share your account credentials or allow others to access the Service through your account.
  • Reproduce, redistribute, or commercially exploit any ExamCast content.
  • Interfere with or disrupt the integrity or performance of the Service.

11. Limitation of Liability

11.1 Service Provided "As Is"

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. ExamCast does not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components.

11.2 Exclusion of Liability

To the maximum extent permitted by the laws of England and Wales, ExamCast, its officers, directors, employees, and agents shall not be liable for:

  • Any examination outcomes, grades, marks, or academic results, whether or not you used ExamCast materials in your revision.
  • Any discrepancy between the content of our predicted papers and the content of any actual examination.
  • Any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or loss of opportunity.
  • Any reliance you place on the information, predictions, or analysis provided by the Service.
  • Any interruption, suspension, or termination of the Service.
  • Any actions taken by third parties, including examination boards, in relation to your use of the Service.

11.3 Cap on Liability

In any event, ExamCast's total aggregate liability to you for all claims arising out of or relating to the use of the Service shall not exceed the total amount paid by you to ExamCast in the twelve (12) months immediately preceding the event giving rise to the claim.

11.4 Statutory Rights

Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited under the laws of England and Wales. These Terms do not affect your statutory rights as a consumer under UK law, including the Consumer Rights Act 2015.

12. Indemnification

You agree to indemnify, defend, and hold harmless ExamCast, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; or (d) any content you submit, post, or transmit through the Service.

13. Termination

  • ExamCast may suspend or terminate your account at any time, with or without notice, if we reasonably believe you have breached these Terms or engaged in conduct that is harmful to the Service, other users, or ExamCast.
  • You may request deletion of your account at any time by contacting us at admin.examcast@gmail.com.
  • Upon termination, your right to use the Service ceases immediately. Sections of these Terms that by their nature should survive termination (including but not limited to Sections 5, 6, 7, 11, 12, 14, and 15) shall continue to apply.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in this clause affects your rights as a consumer to bring proceedings in your local courts if you are entitled to do so under applicable law.

15. General Provisions

15.1 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.

15.2 Entire Agreement

These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and ExamCast regarding your use of the Service and supersede all prior or contemporaneous agreements, understandings, negotiations, and communications, whether written or oral.

15.3 Waiver

No failure or delay by ExamCast in exercising any right, power, or remedy under these Terms shall operate as a waiver of that right, power, or remedy.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. ExamCast may assign or transfer its rights and obligations under these Terms without restriction.
